Terms and Conditions for High Performance App by Pro-Sportlab (PSL) Effective Date: 01 January 2025 

Welcome to High Performance, the mobile application provided by Pro-Sportlab Ltd. (“PSL,”  “we,” “us,” “our”). By using the High Performance app (the “App”) and its services, you agree  to the following Terms and Conditions (the “Terms”). Please read them carefully before  accessing or using the App. 

  1. Use of the App 

The High Performance app is designed to provide athletes with access to rich content,  including videos, podcasts, e-books, and PDFs (collectively, “Content”). This Content offers  sports-related guidance, tips, and advice aimed at improving both physical and mental well being, upgrading and development. 

By accessing the App, you agree to use the App and its Content solely for personal, non commercial purposes. 

  1. Prohibited Uses 

You may not:  

  • Resell, redistribute, or market any of the Content accessed via the App to third parties. • Duplicate, copy, or reproduce any Content for commercial purposes. • Use the App or its Content in any way that could damage, disable, overburden, or  

impair the functioning of the App or interfere with any other user’s enjoyment and  access.  

You may:  

  • Share the publicly available Content, including via social media or other platforms,  provided that such sharing is not for commercial benefit. 
  • Engage with the App’s community by interacting with other users and participating in  discussions or activities offered within the App. 
  • Directly communicate with the High Performance Coach through the App’s messaging  tools for guidance and advice. 
  1. Inappropriate Behavior 

Inappropriate language, behaviors, or posts within the App, or sharing of inappropriate content  on social media, may result in the removal of a subscriber from the App. PSL reserves the  right to impose further restrictions on access or re-accessing the App, including permanent or  temporary suspension of services. 

  1. Account Registration and Data Collection

To access certain features of the App, you may be required to create an account. Upon  registration, you will be asked to provide basic personal information, such as your name and  email address. By providing this information, you agree that PSL may collect and store your  personal data for account creation and functionality purposes. 

PSL does not intend to use your personal data outside the scope of this App. However, you  may be contacted in the future regarding promotional offers or new developments. If you wish  to receive such communications, your name and email address may be retained for this  purpose. 

You are responsible for maintaining the confidentiality of your login credentials and ensuring  that your account remains secure. 

  1. Content Ownership and Intellectual Property 

All Content provided by PSL within the App, including images, videos, and written material, is  the intellectual property of PSL or its respective copyright holders. You may not use any part  of the Content for commercial purposes outside of the App, including resale or redistribution. 

Image Disclaimer: The images used in the App may have been sourced from external online  platforms, and the copyright ownership likely belongs to the original creators. These images  are used for illustrative purposes only and do not imply any endorsement by the copyright  holders. The images are not permitted to be used for commercial purposes outside of this  App. 

  1. Limitation of Liability 

You acknowledge and agree that your use of the App is at your own risk. PSL does not assume  responsibility for any damages, injuries, or losses that may result from your use of the App or  its Content, including but not limited to, any physical or mental harm arising from following  advice, engaging with other users, or using the App’s features. 

PSL shall not be held liable for any indirect, incidental, or consequential damages resulting  from the use of the App, whether caused by negligence or otherwise. You accept full  responsibility for any outcomes arising from your access and use of the App, including the  times, days, and circumstances at which you choose to use the App. 

  1. Data Protection and Compliance 

The App is available globally and is designed to comply with international data protection laws  and regulations, including the General Data Protection Regulation (GDPR). Personal data  will only be processed in accordance with applicable laws. 

PSL does not collect personal data for any purpose other than to provide the services and  functionality of the App. If you choose to receive communications from PSL in the future, your  personal data (such as email address) may be retained solely for this purpose. 

  1. Termination of Access

PSL reserves the right to suspend or terminate your access to the App at any time, without  notice, if we believe you have violated these Terms or have engaged in behavior that is harmful  to the community or the proper functioning of the App. 

  1. Updates to the Terms and Conditions 

PSL reserves the right to modify these Terms at any time. Any changes will be reflected in this  document. We encourage you to review these Terms periodically to stay informed of any  updates. 

  1. Governing Law and Dispute Resolution 

These Terms are governed by and construed in accordance with the laws of England and  Wales. Any disputes arising from the use of the App will be subject to the exclusive jurisdiction  of the courts located in England.
